Terms of Service

1. General
- These Terms govern the use of CJakCiasteczko (the “Service”) provided electronically by aveneo Dawid Morzyński — a Polish sole proprietorship registered with NIP 7792268011, ul. Dmowskiego 124, 60-124 Poznań (“aveneo”).
- The Service provides a GDPR + Google Consent Mode v2 compliant cookie consent management platform — a JavaScript snippet pasted on the Customer's website plus a management dashboard.
- The Customer is a sole trader, legal entity, or organisational unit that registers an account. The Service is intended for businesses (B2B); it is not addressed to consumers.
2. Formation of agreement
- The agreement is concluded upon registration and acceptance of these Terms.
- The first 30 days are free (“Trial Period”). After it ends, an active subscription is required to continue (see § 4).
- aveneo reserves the right to refuse the Service in cases of suspected abuse, breach of § 5, or failure to meet technical requirements.
3. Technical requirements
An up-to-date browser with ES2019+ JavaScript, internet access, and an email account. The CJakCiasteczko script works on all modern browsers (Chrome, Safari, Firefox, Edge) on versions released within the past 24 months.
4. Payment
- After the Trial, the Customer picks a plan from the current pricing page. Prices are in PLN (PL) or EUR (EN).
- Payment processing by Stripe Payments Europe Ltd. (Ireland). The Customer also accepts Stripe's terms during checkout.
- Subscriptions auto-renew monthly (or yearly, if selected). Cancellation is possible in the dashboard at any time and takes effect at the end of the current period.
- Upgrades take effect immediately with proration; downgrades at the start of the next billing cycle.
- VAT invoices are issued electronically and available in the dashboard plus emailed. aveneo is a registered VAT taxpayer.
5. Acceptable use
The Customer agrees NOT to use the Service to:
- violate Polish or EU law, including GDPR,
- circumvent consent requirements imposed by GDPR/ePrivacy,
- distribute malware via the consent banner,
- conduct activity contrary to good morals or third-party rights,
- reverse engineer or recreate the Service's source code.
aveneo may suspend the Service immediately in case of egregious breach. The Customer receives a written reason and 7 days to remediate.
6. Intellectual property
- aveneo retains all rights to the CJakCiasteczko script, dashboard, documentation, and other Service elements.
- The Customer receives a non-exclusive, non-transferable, time-limited licence to use the script on registered domains.
- The Customer retains all rights to their data — configurations, scan results, visitor consent records.
7. Customer data
aveneo does not use Customer or end-user data for any purpose other than providing the Service. Details in our Privacy Policy and DPA.
On termination, aveneo exports Customer data as CSV or NDJSON on request and permanently deletes it within 30 days.
8. Liability
- aveneo uses reasonable efforts to keep the Service operating correctly but does not guarantee uninterrupted availability. Planned maintenance windows are announced 24 hours in advance.
- aveneo is not liable for loss of revenue, loss of data, or indirect damages — except for wilful misconduct. aveneo's aggregate liability is capped at the amount paid for the 12 months preceding the event.
- The above limitation does not apply to wilful misconduct or where mandatory law provides otherwise.
9. Complaints
Send complaints to cjakciasteczko@aveneo.pl. aveneo responds within 14 days.
10. Changes
Material changes are communicated to active Customers by email at least 30 days in advance. No opt-out within that period means acceptance. The Customer may terminate effective end of the current billing period.
11. Final provisions
- Polish law applies.
- Disputes are resolved by the court with jurisdiction over aveneo's seat. Parties agree to attempt amicable resolution first.
- Matters not regulated here are governed by the Polish Civil Code and the Act on Provision of Electronic Services.
